Eitan Biran, an orphaned
six-year-old Israeli boy who was the sole survivor of the
Mottarone mountain cable-car disaster in Piedmont in May, was
taken out of Italy by his maternal grandfather last month and
was ordered by a court to be returned to his maternal aunt in
Italy on Monday, was not returned to the grandfather Monday
night as the terms of his alternating custody demand, the
grandfather's family said Tuesday.
Grandfather Shmuel Peleg's family appealed to the court again
"in the hope that this time it will grasp how yesterday's
decision has immediately become a deadly weapon in the hands of
(maternal aunt) Aya BIran".
The court said that Eitan should spend three days with the
BIrans and three days with the Pelegs pending his return to
Italy and pending an appeal by the Pelegs.
The Tel Aviv family court ruled Eitan's habitual residence was
in Italy, according to the Hague Convention on Monday.
The paternal grandfather, Shmuel Peleg, is being probed in Italy
for alleged aggravated kidnapping.
Eitan was reportedly driven across the border to Switzerland and
flown to Tel Aviv on a private jet after being taken out by his
grandfather during a visit.
Eitan's parents, great grandparents and two-year-old brother
were among the 14 victims of the disaster.
Eitan, who moved to Italy with his parents in 2018, had been put
into the care of his Italian-based paternal aunt, Aya Biran,
after the disaster by the Italian authorities.
