The European Union Court of Justice
on Thursday rejected 2013 Italian legislation banning the
marketing of single-use bags made of non-biodegradable and
non-compostable materials but in line with the provisions of the
1994 EU directive on grounds it is in violation of EU law.
However, in its ruling the Court also said that the 2013 law
"can be justified by the objective of ensuring a higher level of
environmental protection provided that it is based on new
scientific evidence relating to the protection of the
environment that has come to light since the adoption of a
European Union standard, and provided that the State
communicates to the Commission the measures envisaged and the
reasons for their adoption".
